Terms and Conditions

This page outlines the terms and conditions applicable to buyers of digital products and services (electronic tickets, subscriptions, membership cards, vouchers, etc.) available on the tixMondo platform.

For the terms and conditions applicable to businesses/event organizers and facilities, please refer to the dedicated section on the platform.

For the privacy policy, please consult the document available in the "Privacy Policy" section.

The services provided through https://tixmondo.ro are intended for individuals of legal age (at least 14 years old with full legal capacity) and legal entities (regardless of their legal form).

By creating an account and using tixMondo’s services, the user declares that they have the legal right to access and use the platform and assumes full responsibility for the selection and use of the services.

1. General Terms

1.1. This document ("Terms and Conditions") establishes the conditions under which any person may access the https://tixmondo.ro website and use the services provided through it.

1.2. Using the services, placing an order, or continuing to browse the website constitutes full and unconditional acceptance of these Terms and Conditions.

1.3. Questions, requests, or clarifications regarding these Terms and Conditions can be addressed via a message to: https://tixmondo.ro/support/contact/form.

1.4. For the purposes of these Terms and Conditions:

  • "Website Administrator" refers to tixMondo S.R.L., with its registered office in Bucharest, Romania;
  • "Website" or "tixMondo" refers to the https://tixmondo.ro website and the tixMondo mobile applications available on the App Store and Google Play;
  • "User" refers to any person accessing or using the services provided through the tixMondo website;
  • "Digital Products" refers to electronic tickets, subscriptions, membership cards, vouchers, or other services available for purchase on the platform;
  • "Organizer/Business" refers to the entity (restaurant, bar, event organizer, fitness center, etc.) that uses tixMondo to offer digital products or services to users.

2. How It Works

2.1. tixMondo is a ticketing and digital products platform (independent intermediary) through which users can purchase electronic tickets, subscriptions, membership cards, vouchers, and other services offered by organizers/partners. Orders completed on the https://tixmondo.ro website are confirmed via a registration email. Digital products (e.g., tickets) are delivered in electronic format (PDF and/or digital wallet file, where available) to the user’s account and/or via email after payment is completed.

2.2. Upon successful completion of an online order, the user receives the purchased products at the provided email address (e.g., for 4 tickets – a PDF file with 4 pages or 4 individual files, depending on the event). Access to the event for which tickets were purchased is granted by scanning the QR code (and/or another unique identifier, such as a barcode/NFC) on the ticket. Each code is unique and allows only one entry. After scanning and validation, the same code cannot be used for another entry. We recommend presenting tickets directly on the phone screen; printing is optional, except where otherwise specified by the organizer.

2.3. Users may opt to receive commercial communications from tixMondo (offers, event alerts, news) by voluntarily subscribing through the dedicated section on the website or during the order process. Consent can be withdrawn at any time:

  • By clicking the unsubscribe link in each received email; and/or
  • By sending a message to https://tixmondo.ro/support/contact/form with an unsubscribe request. Unsubscribing does not affect necessary transactional communications (order confirmations, tickets, receipts, event change notifications, etc.).

2.4. Upon online purchase, tixMondo clearly displays the product price (set by the organizer) and the platform’s intermediation/operation fees (tixMondo fees and, where applicable, payment processor fees), ensuring the total payment amount is transparent before order confirmation.

2.5. After redirection to the payment processor, users typically have a maximum of 10 minutes to complete the payment; otherwise, the order expires, and the selected products/places may become available to other customers. Adding items to the cart or initiating payment does not guarantee product reservation until payment is confirmed. During high-traffic periods, virtual queues and/or automatic relocation of reservations before payment may occur, managed by the system to ensure platform stability.

3. Customer Relations

3.1. The Website Administrator provides users with a single point of contact for requests, questions, or complaints related to the services offered through the tixMondo platform, available at https://tixmondo.ro/support/contact/form.

3.2. Requests sent to this address are recorded in an internal electronic ticketing system, ensuring efficient and transparent handling. The tixMondo team processes requests in the order they are received. Depending on the complexity of the request and workload, response times may vary from a few hours to a few business days. All customers receive the same level of priority and attention.

3.3. For traceability and accuracy, communication with customers is conducted exclusively in writing (via email and the ticketing system). This allows us to track conversation history and provide precise responses.

3.4. In urgent situations, tixMondo reserves the right to contact users by phone using the contact details provided during the order process, but the official and documented response will always be provided through the written support system.

4. Payment Methods

The following payment methods are available for purchasing digital products through the tixMondo platform:

4.1. Card Payment

  • Payments by debit or credit card (Visa, Mastercard, and, where applicable, American Express) are processed through tixMondo’s online payment processing partners.
  • Card details are not stored by tixMondo but are processed exclusively by the payment processor via a secure connection (SSL/TLS).
  • Users may opt for quick payment functionality, where subsequent transactions require only the card’s security code (CVV/CVC) for confirmation.
  • Some transactions may incur processing fees (clearly indicated at the time of payment).

4.2. PayPal Payment

  • Users with a PayPal account can pay directly using this method.
  • Currency conversion is applied at PayPal’s exchange rate at the time of the transaction.
  • PayPal processing fees, if applicable, are displayed separately on the payment page.

4.3. Bank Transfer (Payment Order)

  • In certain cases (e.g., corporate purchases or large orders), users may opt for payment via bank transfer.
  • To use this method, users must submit a request to https://tixmondo.ro/support to receive bank details and payment instructions.
  • The order is processed and confirmed only after the payment is recorded in tixMondo’s account.

4.4. Installment Payments (if available through the payment processor)

  • Depending on the payment processor and the user’s card, installment payment options may be available. Details regarding the number of installments, applicable fees, and specific conditions are displayed during the payment process.

4.5. Invoicing

  • Invoices for purchased digital products (tickets, subscriptions, membership cards, vouchers, etc.) are issued by the event/facility organizer, on whose behalf tixMondo facilitates the sale.
  • If users require an invoice for an individual or legal entity, they can request this by completing the contact form at https://tixmondo.ro/support/contact/form.
  • The request will be forwarded to the organizer, who is responsible for issuing the invoice based on the provided billing information.

5. Refunds

5.1. tixMondo is an intermediary platform. Therefore, the responsibility for refunding the value of digital products (tickets, subscriptions, membership cards, vouchers, etc.) lies with the organizer or business that issued the product.

5.2. In the event of an event cancellation or other situations where the organizer accepts returns, tixMondo facilitates the technical refund process based on the organizer’s instructions.

  • Refunded amounts apply only to the product price (ticket, subscription, etc.), and tixMondo’s intermediation and platform operation fees are non-refundable, as the service was provided at the time of purchase.

5.3. To request a refund, users must complete the form available at https://tixmondo.ro/support/contact/form. The request will be forwarded to the organizer, who is responsible for validating and processing it.

5.4. The actual refund method (bank transfer, card refund, voucher, etc.) depends on the organizer’s policy and the payment method used at the time of purchase.

5.5. The purchase of event tickets and other digital products with a fixed usage date falls under the exceptions provided by GEO 34/2014 regarding consumer rights, pursuant to Article 16(l), and is not subject to a right of withdrawal. By completing the order, the user acknowledges and agrees that:

  • Refunds for tickets or digital products are possible only if permitted by the organizer;
  • tixMondo cannot be obliged to directly refund amounts without instructions from the organizer.

5.6. If the organizer has already transferred the refund amounts to tixMondo, these will be returned to the user within a maximum of 14 business days from the date of request approval.

5.7. Refund requests are not accepted after the event/service has taken place, except in cases of cancellation confirmed by the organizer.

6. Relocations

6.1. In certain situations, the organizer reserves the right to modify the seats or access conditions for purchased products (e.g., changing seat locations, reassigning to a different category, rearranging the venue, or modifying the type of membership card or voucher).

6.2. In such cases, the organizer is obliged to inform buyers in advance and provide one of the following options:

  • Acceptance of the new access/seating conditions; or
  • Requesting a refund of the product’s value, subject to the organizer’s policies.

6.3. tixMondo does not make decisions regarding relocations and cannot guarantee the availability of the original seats/services. tixMondo’s role is solely that of a technical intermediary, facilitating communication between the buyer and the organizer.

6.4. Users dissatisfied with relocations may submit a request through the support form at https://tixmondo.ro/support/contact/form, which will be forwarded to the organizer for resolution.

7. Data Traffic

7.1. Using the tixMondo platform requires internet access. Data traffic generated by using the services (browsing the website, downloading tickets, accessing the mobile app, receiving notifications, etc.) is charged according to the user’s telecommunications provider’s tariff plan.

7.2. tixMondo does not charge additional data traffic fees and has no control over costs generated by the internet connection or the user’s tariff plan.

7.3. The responsibility for ensuring a stable and functional internet connection lies solely with the user. Without it, certain functionalities (downloading tickets, validating QR/NFC codes, accessing notifications) may be unavailable.

8. Vouchers

8.1. Refund Vouchers

  • In the event of an event or service cancellation, the organizer may offer a refund voucher instead of a monetary refund.
  • The voucher is issued by the organizer and can be used exclusively for purchasing digital products available through tixMondo, up to the voucher’s value.
  • The validity and conditions of use of the voucher are determined by the organizer.
  • If the order value is less than the voucher’s total value, the remaining balance may be used later within the validity period, subject to the organizer’s rules.

8.2. Gift Vouchers

  • Organizers may offer gift vouchers for purchase through tixMondo.
  • Upon order completion, the voucher is delivered in electronic format (PDF/email).
  • The validity and conditions of use are determined by the issuing organizer.
  • If the order value is less than the voucher’s value, the remaining balance may be lost or converted into a new voucher, depending on the organizer’s policy.

8.3. Voucher Cancellation

  • tixMondo and/or the organizer reserve the right to cancel vouchers suspected of being obtained fraudulently or through platform abuse.

9. Network Overload Protection

9.1. In situations of high demand for certain digital products (tickets, subscriptions, membership cards, etc.), tixMondo may temporarily limit the number of products available for purchase to protect platform stability and ensure a fair experience for all users.

9.2. In such cases, measures may include:

  • Virtual queues – users are directed to a waiting list and gain access gradually to complete their order;
  • Temporary stock blocking – certain product categories may appear as sold out and be made available again as traffic decreases;
  • Limiting the number of products per user – to prevent excessive purchases and unauthorized reselling.

9.3. These practices are standard in the ticketing and e-commerce industry and aim solely to protect technical infrastructure and maintain platform functionality during high-traffic periods.

9.4. tixMondo does not guarantee the continuous availability of a product added to the cart until payment is completed.

10. Protection Against Automated Ticket Purchase Scripts

10.1. To ensure a fair and secure experience for all users, tixMondo implements mechanisms to protect against the use of software robots ("bots") or automated scripts that attempt to purchase tickets/digital products in an unauthorized manner.

10.2. The system can automatically detect and block suspicious transactions that mimic automated behavior, such as:

  • Multiple requests in a very short time;
  • Use of extensions, programs, or applications that bypass the standard purchase process;
  • Behaviors identified as bot attacks.

10.3. If a transaction is blocked by the system, the products will not be issued, and the order will not be confirmed. In such cases, users may contact the tixMondo team via https://tixmondo.ro/support/contact/form for manual case verification.

10.4. tixMondo reserves the right to suspend platform access for users attempting to use automated or abusive methods to purchase products.

11. Fraud Prevention

11.1. Users are obliged to use the tixMondo platform in good faith and in accordance with these Terms and Conditions and applicable legislation.

11.2. Abusive use of the platform’s functions is prohibited, including but not limited to:

  • Creating false accounts;
  • Using payment details that do not belong to the user;
  • Attempting computer fraud or bypassing security mechanisms;
  • Attempting to modify or copy digital products (tickets, cards, vouchers, etc.).

11.3. tixMondo reserves the right to cancel orders suspected of fraud or platform abuse. In such cases:

  • The digital products associated with those orders will not be validated for event access or use;
  • Payments will not be refunded if the user is found to have attempted to defraud the system.

11.4. Depending on the severity of the situation, tixMondo may take additional measures, such as:

  • Suspending or deleting the user’s account;
  • Blocking access to the platform;
  • Notifying the competent authorities.

11.5. tixMondo cooperates with organizers and authorities to prevent and combat fraud attempts.

12. Limited Visibility Seats

12.1. In some cases, organizers may offer seats with partial or limited visibility of the stage/performance.

12.2. Such seats are marked as such by the organizer in the tixMondo system, and buyers are informed of this characteristic before completing the purchase.

12.3. Purchasing such seats constitutes the user’s explicit acceptance of the limited visibility conditions.

12.4. Complaints regarding seat visibility do not constitute grounds for refunds or ticket exchanges unless otherwise decided by the organizer’s policy.

12.5. tixMondo is not responsible for the visibility quality of seats provided by organizers.

13. tixMondo’s Liability

13.1. tixMondo acts solely as a technical intermediary between organizers/businesses and users.

13.2. The responsibility for event execution, service validity, quality of artistic or sports performances, adherence to schedules, and legal obligations lies entirely with the organizers.

13.3. tixMondo cannot be held liable for:

  • Program changes, postponements, or cancellations decided by the organizer;
  • Venue conditions (security, visibility, sound, etc.);
  • Loss, damage, or theft of tickets after delivery;
  • Any damages resulting from the organizer’s or participants’ behavior.

14. Force Majeure

14.1. Neither tixMondo nor the organizers can be held liable for failure to fulfill contractual obligations due to force majeure events.

14.2. "Force majeure" refers to any unpredictable, insurmountable, and unavoidable event, such as natural disasters, fires, floods, earthquakes, epidemics, government actions, wars, strikes, or telecommunications/internet infrastructure failures.

14.3. In the event of force majeure, the execution of obligations is suspended for its duration without liability for damages.

15. Intellectual Property Rights

15.1. All elements of the tixMondo platform (software, databases, graphic interface, logo, design, texts, images, multimedia elements) are protected by copyright and intellectual property laws.

15.2. Users are entitled to use the platform solely for personal use in accordance with these Terms and Conditions.

15.3. Copying, reproducing, modifying, distributing, publishing, transmitting, or creating derivative works from the platform’s content without tixMondo’s prior written consent is prohibited.

15.4. The tixMondo trademark and all other trademarks displayed on the platform are the property of tixMondo or its partners and may not be used without permission.

16. License Granted to tixMondo for Uploaded Content

16.1. By uploading, transmitting, posting, publishing, or otherwise making available any data, information, materials, texts, images, graphics, audio-video files, branding elements, event descriptions, reviews, feedback, messages, or any other type of content, regardless of form or medium ("User Content"), on the tixMondo platform, the user grants tixMondo a free, non-exclusive, worldwide, perpetual, irrevocable, transferable, and fully sublicensable license to such content.

16.2. This license includes, without limitation, the following rights:

  • The right to use, reproduce, and distribute the User Content in whole or in part;
  • The right to modify, adapt, translate, transform, or create derivative works based on the User Content;
  • The right to publicly communicate and make the User Content available through any current or future technical means, including digital platforms, social media, advertising campaigns, promotional materials, audio-video broadcasts, and online streaming;
  • The right to associate the User Content with tixMondo’s brand, logos, trademarks, or other visual identity elements or those of its partners;
  • The right to archive, store, and index the User Content in databases and use it for statistical, analytical, or algorithmic training purposes for recommendation systems.

16.3. The user declares and warrants that they hold all rights, licenses, authorizations, and consents necessary to grant this license and that the User Content does not and will not infringe the rights of third parties (including copyright, trademarks, trade secrets, publicity, or privacy rights).

16.4. tixMondo may use the User Content for any purpose related to the operation, promotion, expansion, and development of the platform, including but not limited to marketing, advertising, communication campaigns, product testing, market research, commercial demonstrations, and presentations to investors or partners.

17. Privacy Policy

17.1. tixMondo processes users’ personal data in accordance with applicable legislation and the Privacy Policy available in the dedicated section on the website.

17.2. By creating an account and using the platform, users declare that they have read and understood the Privacy Policy and consent to the processing of their data in accordance with it.

17.3. tixMondo takes technical and organizational measures to protect personal data against unauthorized access, loss, or misuse.

18. Data Sharing with tixMondo Partners

18.1. Users understand and agree that, by using the platform, certain data collected by tixMondo (including personal data, technical data, behavioral data, or transaction information) may be stored, processed, transferred, and shared with tixMondo’s contractual partners, both within and outside the European Union, for legitimate purposes, including but not limited to:

  • Sending personalized commercial offers and promotional materials;
  • User profiling and segmentation for marketing and statistical analysis;
  • Optimizing advertising and remarketing campaigns;
  • Providing related services (payment processors, courier services, cloud hosting, technical support providers).

18.2. Shared data may include, for example: name, surname, email address, phone number, digital identifiers (cookies, IP addresses, device IDs), preferences expressed on the platform, order history, browsing behavior, and interactions with marketing campaigns.

18.3. tixMondo’s partners may use this data in accordance with their own privacy policies, over which tixMondo has no direct control. While tixMondo requires its partners to adhere to reasonable security and confidentiality standards, users understand and agree that tixMondo cannot be held liable for how partners use the data once transferred, within the limits of applicable legislation.

18.4. Users may receive commercial, advertising, or promotional communications from tixMondo or its partners related to their inferred or expressed interests. Users have the right to withdraw their consent or adjust their preferences regarding direct marketing through the channels provided on the platform or by partners (e.g., unsubscribe links in emails).

18.5. By accepting these Terms and Conditions, users expressly, freely, and unequivocally consent to the processing and sharing of data as described above.

19. Modification of Terms and Conditions

19.1. tixMondo reserves the right to modify this document at any time to reflect legislative, technical, or operational changes.

19.2. The updated version of the Terms and Conditions is published on the website and takes effect from the date of publication.

19.3. Users are encouraged to periodically review this page. Continued use of the services after the publication of changes constitutes acceptance of those changes.

20. Applicable Law and Jurisdiction

20.1. This document is governed by Romanian legislation.

20.2. Any disputes arising from or in connection with the use of the tixMondo platform will be resolved amicably, and if that is not possible, the dispute will be referred to the competent courts in Romania.

21. Event Cancellation or Modification by the Organizer

21.1. The organizer reserves the right to modify the program, location, date, or conditions of the event.

21.2. In the event of cancellation, the responsibility for refunding the ticket value lies solely with the organizer, in accordance with their policy. tixMondo will facilitate the technical refund process based on the organizer’s instructions.

21.3. In the event of event modification (change of location, time, or date), the organizer is obliged to inform buyers. In such cases, the user may:

  • Accept the modification and use the ticket under the new conditions; or
  • Request a refund of the ticket value, if permitted by the organizer.

21.4. tixMondo’s intermediation fees are non-refundable, as the intermediation service was provided at the time of purchase.

22. Postponed Events

22.1. If an event is postponed to a later date, the tickets remain valid for the new date.

22.2. If the user cannot attend the rescheduled event, they may request a refund of the ticket value in accordance with the organizer’s policy.

22.3. tixMondo cannot guarantee refunds without the organizer’s agreement.

23. Special Products and Additional Services

23.1. Some events may include special products such as VIP tickets, meet & greet packages, backstage access, merchandise, or other additional services.

23.2. The conditions of use, access, and delivery for these special products are determined solely by the organizer.

23.3. Refunds for these products are subject to the organizer’s policies.

24. Customer Responsibility

24.1. The user is responsible for:

  • The accuracy of the information provided when creating an account and placing orders;
  • Keeping account access credentials secure;
  • Verifying their email address and technical settings to receive tickets and notifications.

24.2. tixMondo is not liable for situations where the user:

  • Provides an incorrect email address;
  • Fails to check the "Spam/Junk" folder where automated messages may be delivered;
  • Loses access to their account due to their own negligence.

25. Proper Use of the Account

25.1. Each user may have only one account on the platform. Creating multiple accounts with the same identity or to bypass restrictions is prohibited.

25.2. Users may not use their account to purchase products on behalf of others without their consent.

25.3. Any suspicious, fraudulent, or abusive activity will result in account suspension or deletion.

26. Event Access and Participation Rules

26.1. Event access is granted based on the purchased digital products (ticket, subscription, membership card, etc.), presented in electronic or printed format, as applicable.

26.2. The organizer establishes and communicates participation rules (access time, prohibited items, age restrictions, special security conditions).

26.3. Failure to comply with these rules may result in denied access without a refund.

27. Lost, Stolen, or Damaged Products

27.1. tixMondo is not responsible for the loss, theft, or damage of digital products after they have been delivered to the user.

27.2. In certain cases, at the user’s request and with the organizer’s approval, tixMondo may reissue digital products (tickets, vouchers), provided they have not already been used/validated.

28. Limitation of Liability

28.1. To the maximum extent permitted by law, tixMondo is not liable for:

  • Indirect damages, loss of profit, or damages caused by the use or inability to use the platform;
  • Operational errors caused by external factors (internet failures, power outages, cyberattacks, etc.);
  • Delays or failures in delivering digital products due to organizers or payment processors.

29. Official Communication

29.1. All official communications between users and tixMondo are conducted via:

  • Email (https://tixmondo.ro/support);
  • The contact form available at https://tixmondo.ro/support/contact/form;
  • Notifications sent through the tixMondo platform or mobile apps.

29.2. Telephone communications, social media, or other unofficial channels are not considered official communication methods.

30. Final Provisions

30.1. If any clause in this document is declared null or unenforceable, the remaining provisions remain in effect.

30.2. tixMondo’s failure to exercise a right provided in this document does not constitute a waiver of that right.

30.3. This document constitutes the entire agreement between the parties and supersedes any prior verbal or written agreements regarding the use of the tixMondo platform.
